CANCELLATION POLICY

By proceeding to purchase any of the ByLexie LLC retreats, classes, or any service(s), you (the “user”) acknowledge and agree to be bound by the following Terms and Conditions. Our Terms and Conditions may be updated at any time, after providing notice to you. The user agrees to be bound by any future amendments made to the Terms and Conditions.

  1. DEPOSITS ARE NON-REFUNDABLE.

  2. Full balance is due 8 weeks before start date of retreat unless otherwise noted.

  3. If cancelling 61 days or more prior to the retreat start date, payments are eligible for refunds, with the exception of the nonrefundable deposit.

  4. If cancelling 60 days or less prior to the retreat start date, all payments are nonrefundable.

  5. Any refunds allowed will incur a 3% processing fee.


COVID TRAVEL UPDATE

All deposits are nonrefundable. This includes all COVID related cancellations including, but not limited to: flight changes/cancellations/delays, illness, lock downs, quarantines, border closings, travel requirements, health requirements, negative tests, etc.

Please note, that if the retreat has to be postponed based on border closures then a credit for a guests’ hold deposit will be issued to be used for the postponement date. If the retreat happens as scheduled, but a guest decides not to attend based on any other reason than a country’s border closure, then the regular cancellation policy (stated above) will be maintained.

All attendees agree to adhere to any COVID regulations in place of the location where the retreat is held. All travel mandatory requirements such as vaccinations, boosters, tests will be followed as required by law and while on retreat, guests agree to any local regulations in place.

ByLexie LLC is not responsible nor liable for any retreat participant who contracts Covid (any strain) before, during, or after the retreat.

DISCLAIMERS (ROOMS)
ALL ROOMS ARE FIRST COME, FIRST SERVE – so the sooner you sign up, the more likely your needs will be fulfilled.
If you do not have a roommate, and register for a double occupancy room, you will be paired with another guest who is not yet assigned a roommate.

DISCLAIMER (MEDIA)

By participating in a retreat, guests acknowledge and agree to images and photos of their being and likeness being taken by ByLexie LLC and other participants and that such images may be shared at will online and publicly.

DISCLAIMERS (GENERAL)

The total cost paid is for one space on the retreat (covering room, workshops, excursions, food, and included transportation).
ByLexie LLC is not responsible for lost, stolen, or missing items.
ByLexie LLC is not responsible for airline cancelations, missed flights, or transportation issues prior to the retreat.
All reservations and bookings are first come first serve.
All prices are the same for each guest (with the exception of Early Bird Pricing)
VALID PASSPORT IS REQUIRED if you are leaving your home country to attend retreat. 
Retreat deposit (any amount requested at check out) is non-fundable for any circumstances (including Covid related occurrences).


You have until 61 days before the retreat to request any refunds (all deposits are nonrefundable for any circumstances, including COVID related events and changes).
Travel insurance is NOT included in the price of the retreat, and HIGHLY RECOMMENDED for ultimate protection.
If you do not specify who your roommate is we will assume you are open to any guest. 
You must pay your total retreat balance at least 8 WEEKS prior to the retreat start date by using the provided invoice.
You must sign and return Liability Waiver and Retreat Contract BEFORE the retreat start date.

ByLexie LLC is not responsible nor liable for any retreat participant who contracts Covid (any strain) before, during, or after the retreat.

THIRD PARTY VENDORS

During the retreats, there will be third-party vendors providing services, including catering, transportation, and lodging. ByLexie LLC is not responsible for the acts or omissions of any of these vendors. Although ByLexie LLC strives to provide the best services and products available, ByLexie LLC has no control over such third party vendors and ByLexie LLC is not responsible or liable for any products, materials, or services, or the lack thereof. The user further acknowledges and agrees that ByLexie LLC is not responsible or liable, directly or indirectly, for any damages or loss caused or alleged to be caused by or in connection with use of or reliance on such third party vendors, goods or services.

SEVERABILITY

If any provision of these Terms and Conditions or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of these Terms and Conditions which can be given effect without the invalid provision or application, and to this end the provisions of these Terms and Conditions are severable. In lieu thereof, there shall be added a provision as similar in terms to such illegal, invalid and unenforceable provision as may be possible and be legal, valid and enforceable.

UNCONDITIONAL AND FULL GENERAL RELEASE

USER AGREES TO INDEMNIFY AND HOLD BYLEXIE LLC , ITS OFFICERS, AGENTS AND EMPLOYEES HARMLESS FROM ANY LIABILITY RESULTING FROM THE NEGLIGENT ACTS OR OMISSSIONS OF BYLEXIE LLC, ITS OFFICERS, AGENTS AND EMPLOYEES AND FROM ANY SUIT, CLAIM, ACTION, COUNTERCLAIM, LOSS, EXPENSE OR DAMAGE OF ANY KIND OR NATURE WHATSOEVER AS A RESULT OF CLAIMS, DEMANDS, COSTS OR JUDGMENTS ARISING OUT OF THE ACTS OR OMISSIONS OF BYLEXIE LLC AND ITS OFFICERS, AGENTS AND EMPLOYEES.

USER FURTHER HEREBY AGREES TO INDEMNIFY AND HOLD BYLEXIE LLC, ITS OFFICERS, AGENTS AND EMPLOYEES HARMLESS FROM ANY LOSS, DAMAGE, JUDGMENT, LIABILITY OR EXPENSE (INCLUDING LEGAL FEES) SUFFERED BY OR RENDERED AGAINST BYLEXIE LLC ON ACCOUNT OF ANYTHING ARISING OUT OF THE SERVICES PURCHASED BY USER OR BYLEXIE LLC.
